Notarybd Services (the “Firm”) has created and developed a website  https://www.notarybd.com, a web base software application, integrated various Application Programming Interface ( API’s), Systems and Services (defined below) (collectively, the “Platform”) located in Bangladesh in which users, clients, notary public  can review remote online notarizations and other specified electronic Services and related information and records and can access and obtain online electronic notarization and other services. The Firm is the sole owner of  Notarybd Services and Platform. The brand or trade name of Notarybd Services shall be Notarybd.com.

 

This website and platform Notarybd.com is operated by Notarybd Services. Throughout the site, the terms “Notarybd.com” “Firm” “we”, “us” and “our” refer to Notarybd Services. “Notary Public” refers to Enlisted Notary Public of Notarybd Services. Notarybd Services offers this website, including all information, tools and services available from this site to you, the user, the client, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

 

You are a “Visitor” when you visit the Platform. You are an “Unregister User”, if you apply for registration using our platform to become a registered user. You are a “Registered User” if you have registered to obtain Services via our Platform for your individual use or if you are acting in an authorized capacity on behalf of another person or minor to obtain Services via the Platform. You are an “Other User” without limitation if you access or use the Platform of any registered user account / client for viewing transaction information or data including notarized document(s) and audio-video recording in any other authorized and lawful capacity or manner on behalf of “Registered User / Client.” Our Privacy Policy apply to anyone accessing our Platform either as a Visitor or Unregistered User or Registered User or Other User (collectively, “​you​” and “​your​”). 

 

Notarybd Services is committed to maintaining your privacy. This privacy policy and agreement (the “Privacy Policy”) covers how we collect, use, and treat personal information that you may provide through the Platform or while participating in the services that we offer through the Platform (the “Services”). Our Privacy Policy applies to any visitor,  unregistered user, registered user, other user to the Platform (collectively, “you and your”).

1. Your Consent. Please read this Privacy Policy carefully. Once you consent to this Privacy Policy's terms, it creates legal obligations on you and on Notarybd Services. We ask you to show your consent to the terms of this Privacy Policy in different ways, depending on your relationship to us and the platform. The procedures for consenting to this Privacy Policy are (a) less formal if you are simply a casual Site Visitor, and (b) more formal if you are seeking to become a Registered User.

1.1. Consent by Site Visitors. By accessing and using our Website as a Site Visitor, you are acknowledging that you have read and understood this Privacy Policy and agree to be legally bound by it. If you do not agree with the terms of this Privacy Policy, please refrain from using our Platform. 

1.2. Consent by Registered Users. If you register to be a Registered User of our Platform, you will be prompted to click an "I Accept" button or otherwise indicate your acknowledgement and consent to this Privacy Policy during the registration process. Clicking "I Accept" or otherwise completing the registration process confirms your agreement to be bound by this Privacy Policy. 

By visiting or registering on the Platform, or using any of our Services, you acknowledge that your personal information will be handled as described in this Policy. Your use of our Platform or Services, and any dispute over privacy, is subject to this Policy and our ​Terms of Use​. All defined terms used in this Privacy Policy and which are also used in our Terms of Use have the meanings set forth in the Definitions in our Terms of Use. 

THE INFORMATION WE COLLECT ABOUT YOU 

We collect information about you directly from you as well as automatically through your use of our Platform or Services. 

Information We Collect Directly From You. Most content on the Platform is accessible without an account. However, in order to use the Services on the Platform, you must create an account and become a Registered User. Different Services require that you provide somewhat different forms or types of information, but in general the minimum mandatory information that you as a Registered User or, with respect to certain information, a Registered User creating a Transaction on your behalf must provide is: 

(i) your name;
(ii) your address;
(iii) your e-mail address;
(iv) your mobile phone number;
(v) your Notional Identification Number (NID)  for Notarial Acts;
(vi) a government-issued form of identification;
(vii) depending upon the Transaction, a secondary form of identification document; 

(viii) documents relating to the Services requested; and
(ix) other Transaction information required to provide and complete the Services. 

All of this information is collectively referred to as ​“User Data.​” Where you do not provide this information, we are unable to provide the Services to you. 

The registration process provides Registered Users with a user name and password to enable access to the Services on the password-protected portions of the Platform. 

In order to provide certain of the Services, including Notarization, we provide on the Platform a live video link between you and our enlisted Notary Public and Identity Verification Designated Agent through API so that our enlisted Notary Public or Agent can interact with you and, as applicable, make determinations about your identity and witness the signing of relevant document(s) (the “​Session Video”). This means that we will capture audio and video of Registered User and our Enlisted Notary Public who make use of or participate in the Services and whatever content is displayed during the Session Video. By requesting and participating in the Services, you confirm that all persons depicted in the Session Video are authorized and permitted to participate and have consented to do so.

Information We Collect Automatically. We automatically collect the following information about Visitors or Registered Users through cookies and other web tracking technologies: your IP address (the Internet address of your computer), your computer's name, the type and version of your web browser, referrer addresses, your computer or device location and other generally-accepted log information. We may also record page views (hit counts) and other general statistical and tracking information, which will be aggregated with that of other users in order to understand how our Platform is being used, and for security and monitoring purposes. We may combine this information with other information that we have collected about you, including, where applicable, your name, location and other personal information such as your browsing patterns. Please see the section “Cookies and Other Tracking Mechanisms” below for more information. 

Log Information. We additionally automatically collect information related to Registered Users’ actions on the Platform which may be necessary to create Document, Transaction and account level audit trails. This information generally encompasses all Registered User session activity on the Platform, including but not limited to the following type of information: when and how a Registered User accessed the Platform, registered for an account, was authenticated, created and adopted an electronic or digital signature; and when and how a Document was uploaded to the Platform, any changes or modifications made to a Document by you or anyone else associated with the transaction, and movement of annotations. 

Information we collect from Public Sources. 

For Registered Users, as applicable in the specific context of use of the Platform and delivery of Services, in order to verify identification information as part of our legal and contractual obligations, we will collect and review personal information and identity credentials provided by you through use of identity database services and tools provided by third party service providers. 

 

2. HOW WE USE YOUR INFORMATION 

We use your personal information for the following purposes, subject to any limitations in applicable law or contracts with Registered Users and third parties: 

1. To provide our Services to you, to communicate with you about your use of our Services, to respond to your inquiries, and for other service and opportunity purposes.

2. To record information generated in the course of providing the Services including information provided by you as well as session and audit trail information and the Session Video.

3. To maintain the availability and security of our Platform, to improve the delivery and performance of our Services, to tailor the content and information that we send or display to you, to offer personalized help and instructions to you, and to otherwise personalize your experiences while using the Platform or our Services.

4. To help improve our Platform and Services. In doing so we may aggregate the personal information we collect or remove identifying personal information (“de-identifying”) to limit or prevent identification of any specific user or device. To provide the Services and to address issues and resolve problems, we may also use data that has not been aggregated or de-identified. As one example, we may review transactions, including recorded video of those transactions, to help us check for errors or to address an identified issue with a Transaction.

5. For our own marketing and promotional purposes and for our own products and Services. For example, we may use your email address and mobile phone number to send you newsletters about events or special offers and promotions, or to otherwise contact you about our products or Services we offer which we think will interest you.

6. To better understand how users, access and use our Platform and Services, in order to improve our Platform and Services and respond to user desires and preferences, and for other data analytical purposes. In particular, we allow you to voluntarily participate in surveys and questionnaires which we will use for the purposes of monitoring and improving the use and appeal of the Platform and the Services. 

7. To monitor responses on any blog, message board system, or review capability available on our Platform.

8. To comply with legal obligations, including without limitation the requirements of notarial law including identity verification and record keeping, ICT act, Digital Security Act,            e-signature law, e-sign guideline and other laws applicable to transactions on our Platform; to respond or to meet legal or regulatory requests or requirement(s) in accordance with law; to enforce our legal rights; as part of our general business operations; and for other business administration purposes.

9. Where we believe necessary to investigate, prevent or take action regarding illegal activities or situations involving potential threats to the safety of any person or violations of our Terms of Use or this Policy.

The legal bases for using your personal Information​. We collect your information as a Data Controller when we have a legal basis to do so. The following legal bases pertain to our collection of data:

• Our use of your personal information is necessary to perform a ​contract​ or take steps to enter into a contract with you.

• Our use of your personal information is in our ​legitimate interest​ as a commercial organization to make improvements to our Services, to expand our business and increase revenue and business opportunities, and to ensure that we maintain a reputable status.

• Our use of your personal information is necessary to comply with a relevant legal or regulatory obligation​ that we have. This includes performing compliant Transactions and providing compliant Services; forming and maintaining required records; providing legally required access to information; providing required notices; maintaining secure systems; tracking and managing use of data; and disclosing information where required to a court, authority, agency or regulatory body or member of the public with a right of access.

• Our use of your personal information is in accordance with your ​consent​.

2.1 The Types of Information You May Provide. Information you may provide or that we may collect from you while visiting our Website or while participating in our Services falls into two broad categories: (i) personally identifiable information, and (ii) anonymous information. We use the term “Personally Identifiable Information” mean any information that could reasonably be used to identify an individual, including but not limited to name, address, registered mobile number, e-mail address, date of birth, national identification (NID) number, passport number, Government issued ID number, photograph, video, or any combination of information that could be used to identify an individual.  “Anonymous Information” is information that does not identify you, and may include statistical information concerning, for example, your use of our Services, the features of the Platform or pages on our website that you visit most frequently. 

3. Personally Identifiable Information; Our Uses of This Information. As a Site Visitor, we allow you to decide whether you wish to provide us with Personally Identifiable Information. Accordingly, we have structured our Platform so that you may visit our Website, and review selected information about our Services, without revealing your identity or providing any Personally Identifiable Information. We will only share Personally Identifiable Information you choose to provide to us via the Platform with third parties as expressly disclosed in this Privacy Policy. We will not share it in any other way. We collect information from website Visitors and Registered Users at different points on our Platform and through our Services, and use this information as follows:

3.1. Website Visitors May Only Provide Anonymous Information. As indicated above, you may use our Website without registering or submitting any information to us. In that case, the only information we collect from your visit will be Anonymous Information that does not identify you in any way. Our obligations concerning, and permitted uses of, Anonymous Information are set out below in Section 4 (Anonymous Information).

3.2. Registration Information; User Names. In order to participate in our Services as a Registered User, we require that you complete a registration form and user profile. Our registration form and user profile will specify the information which you must provide in order to participate in our Services, which may include such items as your: (i) name; (ii) address; (iii) registered              e-mail address; (iv) registered mobile number; (vi) Government issued National Identification Card (NID) or Smart Card vii) Selfie or Photo. User must make a prior appointment schedule in order to execute an affidavit in the platform of Notarybd.com. Our registration form and/or user profile may additionally request information, which you may, at your option, choose to provide. The registration process provides Registered Users with a user name and password, which allows them to gain access to the Services on the password-protected portions of the Platform. This information is used by Notarybd.com or authorized service providers or enlisted Notary Public of Notarybd Services solely for internal purposes in connection with providing the Platform and Services. The details of our Services and benefits of becoming a Registered User are set forth on our Website and in our Terms of Use. 

3.2.1. Protecting Your Password. Please be careful to keep your password private. Please refer to our Terms of Use regarding suggestions for protecting your password.

3.3. Notarization Video subject to case by case basis (if required). As further described in our Terms of Use, in order to facilitate to execute an affidavit process, we will provide a live video link between you and our enlisted Notary Public for execution of an affidavit (if required) subject to case by case basis so that the Notary Public can witness the signing of the relevant affidavit document(s) (the “Notarization Video”). The Notarization Video will be recorded and saved by Notarybd Services for 7 days and will also be saved by enlisted Notary Public of Notarybd Services for specific period of time as determined by law. Accordingly, your image and whatever content you display during the live video link will be recorded as part of the Notarization Video. Please note that it is your responsibility to ensure that the video does not include any unintended individuals or nonidentifying information. By participating in a Notarization Video, you represent and warrant that all persons depicted in the Notarization Video have consented to take part in the Notarization Video.

3.4. Third Party Personally Identifiable Information. To the extent that you provide us with the Personally Identifiable Information of third parties, you represent and warrant that you have permission from such third parties to provide us with their Personally Identifiable Information so that we may provide our Platform and our Services.

3.5. Information Collected by Payment Processing Company. Please note that although you may provide your payment information through our Platform, Notarybd Services does not store your financial account information. Notarybd Services uses a reputable service provider (the "Payment Processing Company") known as Online Payment Gateway Company to collect and process your payment information. Our Platform and Services contain a link to a third-party payment processing company to enable you to make payment for any Services in the event your payment obligations to us are not managed through invoicing and other methods of payment. This payment processing company acts as separate entity and controller as that term is defined by applicable law in relation to any billing or credit card information, and its processing is not governed by this Policy. We do not hold and store your billing data, other than records of actual charges and related information, and we are not responsible for the information practices of such third party.

3.6. Email Addresses. You may wish to provide us with comments and feedback concerning our Site or our Services. By communicating with us for these purposes, you may provide us with your email address and other Personally Identifiable Information. In these instances, we use any information you provide to us for the purposes for which you submit the information. 

3.7. Questionnaires and Surveys. Our Platform may allow you to participate in surveys and/or questionnaires, which we may post on the Platform from time to time. You are free to choose whether you participate in a survey or questionnaire. We may ask that, in addition to providing your responses, you also provide Personally Identifiable Information. In these instances, we use any information you provide us for the purposes for which you submit the information. Survey and questionnaire information may be used for the purposes of monitoring or improving the use and appeal of this Platform.

3.8. Listserv. You may choose to sign up for our listserv, in which we send you emails with information on news and events. In addition, if you are a Registered User or have previously provided Notarybd Services with your e-mail address, we may choose to send news, bulletins, marketing materials, or other information, and will use Personally Identifiable Information to send such communications. 

3.9. Blogs, Message Boards. We may offer a blog, message board system, or review capability on our Platform and you may choose to participate in an online discussion or to provide online comments. Any comments you contribute on the Platform, however, become public immediately and any Personally Identifiable Information you disclose becomes available to the other users of the Platform. Our Privacy Policy does not cover the information you disclose in such online discussions on our Platform. You should, therefore, use discretion in what you submit to these exchanges.  

4. Anonymous Information. We use Anonymous Information to analyze the effectiveness of our Platform, to improve our Platform and our Services, and for other, similar purposes. In addition, from time to time, we may undertake or commission statistical and other summary analyses of the general behavior and characteristics of Platform users, and the use of our Platform and Services, and may share Anonymous Information with third parties. Rest assured that Anonymous Information provided to third parties will not allow anyone to identify you. We may collect Anonymous Information through features of the software that supports our Platform and our Services, through cookies, and through other means described below. 

4.1. Cookies. A cookie is a small amount of data, which often includes an anonymous unique identifier, which is sent to your browser from a website's computers and stored on your computer's hard drive. Cookies can be used to provide you with a tailored user experience and to make it easier for you to use a website upon a future visit. We may include cookies on our Platform and use them to recognize you when you return to our Platform. You may set your browser so that it does not accept cookies. Cookies must be enabled on your web browser, however, if you wish to access certain personalized features of our Services.

4.2 Our Use of Cookies 

We use cookies and other tracking mechanisms to track information about your use of our Platform or Services. 

Cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Platform and Services, while others are used to enable a faster log-in process or to allow us to track your activities at our Platform and Service. There are two types of cookies: session and persistent cookies. 

●  Session Cookies. Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. We use session cookies to allow our systems to uniquely identify you during a session or while you are logged into the Platform. This allows us to process your online transactions and requests and verify your identity, after you have logged in, as you move through our Platform.

●  Persistent Cookies. Persistent cookies remain on your computer after you have closed your browser or turned off your computer. We use persistent cookies to track aggregate and statistical information about user activity. 

We may use cookies to track your use of the Platform and to recognize you when you return to our Platform. In addition, we use "pixel tags", small graphic images (also known as "web beacons" or "single-pixel GIFS"), to tell us what parts of our Platform have been visited or to measure the effectiveness of searches customers perform on our Platform. Pixel tags also enable us to send email messages in a format customers can read, and they inform us whether emails have been opened, to help ensure that our messages are of interest to our customers. 

Disabling Cookies​. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our Platform who disable cookies will be able to browse certain areas of the Platform, but some features may not function. 

Do Not Track​. Currently, our systems do not recognize browser “do-not-track” requests. You can, however, disable certain tracking as discussed in this section (e.g., by disabling cookies). 

5. Security of Your Personal Information 

We have put in place security systems designed to prevent unauthorized access to or disclosure of the personal information you provide to us, and we take all reasonable steps to secure and safeguard this personal information. Our Platform's password-protected section requires users to give us unique identifiers such as their user name and password. Notarybd Services employees, agents, third party service provider are required to acknowledge that they understand and will abide by our policies with respect to confidential and private information. Additionally, we evaluate our third party service providers based upon the type of information they receive and process for our clients and then, based upon our security guidelines, require key vendors to confirm with us their confidentiality obligations and use of security processes. Moreover, permissioned access to our databases containing personal information is governed by our internal security policy. 

Our security systems are structured to deter hackers and others from accessing information you provide to us. However, due to the nature of Internet communications and evolving technologies, we cannot provide assurance that the information you provide us will remain free from loss, misuse, or alteration by third parties who, despite our efforts, obtain unauthorized access. Accordingly, you should take steps to protect against unauthorized access to your password, mobile phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords, or for any activity on your account via unauthorized password activity, or for any improper uses of your account or password which you permit others to make. 

5.1 User Generated Content: ​If you post content to our Platform, all of the information that you post will be available to all visitors to our Platform. We cannot prevent such information from being used in a manner that violates this Policy, the law, or your personal privacy. 

6. Modify My Personal Information 

Registered Users are able to modify personal information submitted by logging into your account and updating your profile information. You can also email us at support@notarybd.com in order to change your personal information. 

7. Direct Marketing by Us 

Where you have agreed to receive newsletters or similar materials from us, we will send periodic promotional or informational emails to you. You can opt-out of such communications by following the opt-out instructions contained in the e-mail. If you opt-out of receiving emails about recommendations or other information we think may interest you, we will still send you service messages about your account or any Services you have requested or received from us or other notices as required by law.

8. Tags. We may use so-called "pixel tags"— small graphic images (also known as "web beacons" or "single-pixel GIFS") — to tell us what parts of our Platform have been visited or to measure the effectiveness of searches customers perform on our Platform. Pixel tags also enable us to send email messages in format customers can read, and they inform us whether emails have been opened, to help ensure that our messages are of interest to our customers. None of this data includes Personally Identifiable Information, and you can "opt-out" of receiving these types of emails from us by following the directions. If any Personally Identifiable Information is collected using such tools, it will be subject to the terms of this Privacy Policy.

9. Click-Through. We may send email messages, which use a “click-through URL” linked to content on our Platform. When you click one of these URLs, you pass through our web server before arriving at the destination web page. We track this click-through data to help determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked simply do not click text or graphic links in the email, or notify us.

10. Computer Configuration. In order to determine whether your computer is supported by our system, we may collect certain Anonymous Information. This information includes, but may not be limited to, your operating system and browser, as well as the presence of any software that our Platform may require to operate with your computer, or other third party software on your computer. This information is kept confidential and is not shared with third parties, except as provided for in this Privacy Policy.

11. Any Information Linked with Your Personally Identifiable Information Is Protected As “Personally Identifiable Information.”  To enable us to better understand the characteristics of our clients and/or to provide services tailored to your needs, we may link (a) the Personally Identifiable Information you have provided, with (b) Anonymous Information. If we combine or link any Anonymous Information or other information with your Personally Identifiable Information, the resulting combination will be treated and protected as Personally Identifiable Information under this Privacy Policy. Accordingly, no unrelated third parties will have access to this information, and any of our service providers who are granted access to this information will be bound to protect it in accordance with this Privacy Policy.

12. How we share your information? We share your information as follows:

• To Those With A Legal Right To See Such Information​. We will share your information with regulatory agencies, enforcement authorities, parties with a legal subpoena, or members of the public or other parties with the legal right to compel us to provide such information for their review. (Note that notarial register is available for public review under specified conditions and circumstances.) All such sharing by us will be in accordance with the requirements of applicable law.

• Support Community Users.

​​If you upload feedback to any public blog, message board system, or review capability available on our Platform, your user name and any information that you post, including, without limitation, reviews, comments, and text will be available to, and searchable by, all users of the Platform. Messages you send in our Support channel, to us, will be viewable only by you and us.

• Service Providers.​ We disclose the information we collect from you to service providers, contractors or agents who perform services for us. For example, we engage third parties to provide database identity verification support services such as verify your National Identity Number (NID) and.

• Platform Vendors.​ ​We may employ other companies to perform IT functions on our behalf, such as hosting or maintaining the Platform (collectively, "​Platform Vendors​").

• Affiliates.​ We may disclose the information we collect from you to our affiliates or subsidiaries, including third party service provider or vendors. However, if we do so, their use and disclosure of your personal information will be subject to all existing obligations and limitations governing and affecting such data, including under applicable law, all applicable contracts, and as set forth in this Policy and in our Terms of Use.

• Business Transfers​. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or if we are involved in any bankruptcy proceedings, we will transfer the information we have collected from you to the other company. If we do so, its use and disclosure of your personal information will be subject to all existing obligations and limitations governing and affecting such data, including under applicable law, all applicable contracts, and as set forth in this Policy. 

• In Response to Legal Process​. We might also disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.

• To Protect Us and Others.​ We will disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or as evidence in litigation in which Company is involved.

13. Designated Recipients and Transaction Participants With Required Permissions​. Once the relevant document has been electronically notarized, we will send the notarized document via email to the recipient(s) that you designate (each, a “Recipient”). That email will include a link that the Recipient(s) can use to access the notarized document and other data related to the notarization transaction and its participants. Accordingly, the Recipient(s) will be able to view the Notarized Document(s) and transaction and any individuals or Personal Information that are Notarized Document(s) and transaction. You acknowledge and agree that Notarybd Services or Enlisted Notary Public of Notarybd Services is not responsible for any Recipient’s use of the notarized document(s) or transaction or electronic records. 

Any interested party can verify and view key transaction details. If they have the additional / necessary permission or authority, they will also be able to access the video recording of the transaction. Enlisted Notary Public of Notarybd Services electronically seal every transaction using a digital signature certificate issued by a licensed Certifying Authority (CA) and use Encryption under Cryptography Method. To provide simple and secure access, each document is assigned a document unique ID number. Scanning the QR code of notarized document(s) and related records can be accessed on our web verification portal. Any interested party can easily verify the identity of the enlisted Notary Public of Notarybd Services by viewing transaction and verification information about the notary public’s use of his digital signature and certificate.

Designated Recipients and Transaction Participants With Required Permissions​. Notarized Documents, the Session Video and other information resulting from the Transaction and our Services will be shared with any party with the required authority and permissions to see such information after the Transaction is completed. This could include a recipient or other parties to the Transaction with necessary authority and permissions.

14. Question of Harm. We may reveal your Personally Identifiable Information to advocates / lawyers, private investigator organizations or law enforcement agencies if we believe (a) that you are at risk of harm from another, or (b) that you are harming or interfering (or will harm or interfere) with others or violating (either intentionally or unintentionally) our Terms of Use or otherwise violating legal rights.

15. Legal. Notarybd Services or Enlisted Notary Public of Notarybd Services will reveal your Personally Identifiable Information to the extent we reasonably believe we are required to do so by law. If we receive legal process calling for the disclosure of your Personally Identifiable Information we may attempt to notify you via the email address you supplied during registration within a reasonable amount of time before we respond to the request, unless such notification is not permitted.

16. Transfer of Platform. Notarybd Services or Enlisted Notary Public of Notarybd Services shall be entitled to transfer information it collects to a third party, including any Personally Identifiable Information, in connection with a sale of all or substantially all of the assets of the business entity responsible for the Services and the information under this Privacy Policy, provided the acquiring third party has agreed to safeguard your Personally Identifiable Information with protections that in all material respects are the same as or more protective than those set out in this Privacy Policy.  

17. Retention of Personally Identifiable and Notarized Information. Our policy with regard to retention of Personally Identifiable Information is dependent upon whether you are a Visitor or a Registered User. If you are a Visitor, we will only retain Personally Identifiable Information that you have provided for as long as necessary to address the purpose for which you submitted the information. If you are a Registered User, we will retain your Personally Identifiable Information for as long as we you continue to be a Registered User. To the extent you complete a notarization transaction through the Platform, we will retain information and documentation related to the notarization transaction (including associated Personally Identifiable Information) for so long as required by applicable laws and regulations. With respect to the Personally Identifiable Information of third party individuals that you provide, we will only retain such Personally Identifiable Information as long as we need to retain as required and determined by applicable laws and regulations.

 

Please note that we will retain information and documentation related to notarization transactions including associated Personally Identifiable Information in server, storages for so long as required by applicable laws and regulations. You therefore may not remove associated Personally Identifiable Information related to notarization. 

18. Security. We have put in place security systems designed to prevent unauthorized access to or disclosure of Personally Identifiable Information you provide to us, and we take all reasonable steps to secure and safeguard this Personal Information. Our Platform's password-protected section requires users to give us unique identifiers such as their user name and password. Enlisted Notary Public or associates or employees or third-party service provider of Notarybd Services are required to acknowledge that they understand and will abide by our policies with respect to the confidentiality of Personally Identifiable Information. Additionally, we ensure that Notarybd Services’s Platform Vendors’ security policies are at least as protective of your information as our policy. Moreover, we provide access to our databases containing Personally Identifiable Information on a need-to-know basis only. 

19. Participation by Children and Teens; Advisory. Due to national law of Bangladesh, WE DO NOT ALLOW INDIVIDUALS WHO WE KNOW ARE UNDER 18 TO PARTICIPATE IN OUR PLATFORM OR SERVICES. YOU MUST BE AT LEAST 18 YEARS OLD TO USE OUR PLATFORM AND SERVICES. IF YOU ARE BETWEEN 18 AND THE APPLICABLE AGE OF MAJORITY, PLEASE REVIEW THIS AGREEMENT WITH YOUR PARENT OR GUARDIAN. Please understand that we cannot necessarily tell if a user is providing us with his or her true age.

20. Notification of Changes. From time to time, Notarybd Services may change its Privacy Policy. We will post notice of the new Privacy Policy on our Platform. With respect to Visitors, your use of our Platform following any such change constitutes your agreement to follow and be bound by the Privacy Policy, as changed. With respect to Registered Users, you will be provided an opportunity to confirm your acceptance of the change the first time you log into the Platform following the change to the Privacy Policy. 

21. Our Affiliates. We may choose to rely on and share information with other companies closely related to us – our "Affiliates" – for certain purposes under this Privacy Policy. By "Affiliate," we mean an entity that controls, is controlled by, or is under common control with Notarybd Services or Enlisted Notary Public of Notarybd Services, whether the control results from equity ownership, contract, overlapping management or otherwise. In this context, "control" means the ability to replace the officers or directors or otherwise materially influence or control management decisions. You agree that Notarybd Services or our Enlisted Notary Public or our Affiliates will be entitled to enjoy our rights under this Privacy Policy and, in exchange, we agree that we will not be responsible for our Affiliate's conduct under this Privacy Policy, if our Affiliate fails to comply with any resulting obligations. In any event, we ensure that our Affiliates agree to protect Personally Identifiable Information in a manner no less protective of your interests than the protections set out in this Privacy Policy.

Notarybd Services or Enlisted Notary Public of Notarybd Services does not control and is thus not responsible for the content or privacy practices and policies of such other sites. We encourage our users to be aware when they leave our website and to read the privacy statements of each and every website that collects personally identifiable information. 

23. Important Information About Use of our Website and Platform

Notarybd Services to assist it in the collection and processing of registered user’s information in support of our services. Notarybd Services is very sensitive to privacy issues. We have adopted this privacy policy and posted this notice to let you know how we handle the personal information we receive from you in connection with your use of our website and platform in connection with our services  To the maximum extent possible, we collect personal data directly from the data owner, including the personal data entered into our website and platform. By your use of our website and platform, you authorize us to collect, aggregate, use, storage, and disclose of the personal data you submit as required to provide you with our service. By your use of our website and platform, you are authorizing receipt of electronic communications, including interactive voice response and call center communications, regarding our services. If you do not wish to be contacted by Notarybd Services, please do not use our website and platform. Notarybd Services will use your personal data only for the following purposes:

• to collect registered user information for the submission to our enlisted Notary Public;

• to transmit your personal data to our enlisted Notary Public, or share personal data with our subcontractors, vendors and suppliers as necessary to process our service as requested by you;

• to comply with applicable laws, regulations, and legal process;

• to protect someone’s health, safety, or welfare;

• to protect our rights or take appropriate legal action; or

• as otherwise necessary in the performance of our contract with enlisted Notary Publics, service providers, vendors, so long as such use is permitted by law and is consistent with the other limitations listed here.

 

Notarybd Services collects your data and information only that information necessary to process our service as requested by you and will only maintain your personal data for the minimum amount of time required by our service and our contract with enlisted Notary Publics, service providers, vendors. We may also use your data and information such as your Internet Protocol (IP) address, Internet Service Provider, operating system, the time and date of your visit, your location and other site use statistics collected automatically by our website and platform for statistical reporting, analysis regarding the use and effectiveness of our website, platform and other reporting requirements under our contract. To protect your data, we have  implemented appropriate organizational, technical, and physical safeguards to prevent the unauthorized access or disclosure of your personal data and information. We also require the same high level of information security from all third parties who may assist in the processing of your personal data and information, such as our enlisted Notary Publics, service providers, subcontractors, vendors and suppliers. (৫) নোটারিয়াল আইনের জন্য আপনার ন্যাশনাল আইডেন্টিফিকেশন নম্বর;

(৬) সরকার কর্তৃক জারি করা শনাক্তকরণ ফর্ম;

(৭) লেনদেনের উপর নির্ভর করে, শনাক্তকরণ নথির একটি গৌন রূপ;

(৮) অনুরোধ করা পরিষেবা সম্পর্কিত নথি; এবং

(৯) পরিষেবা প্রদানের এবং সম্পূর্ণ করার জন্য প্রয়োজনীয় অন্যান্য লেনদেনের তথ্য।

 

এই সমস্ত তথ্য সমষ্টিগতভাবে "ব্যবহারকারী ডেটা" হিসাবে উল্লেখ করা হয়। যেখানে আপনি এই তথ্য প্রদান করবেন না, আমরা আপনাকে পরিষেবা প্রদান করতে অক্ষম।

মনোনীত প্রাপক এবং প্রয়োজনীয় অনুমতি সহ লেনদেন অংশগ্রহণকারীঃ নোটারাইজড ডকুমেন্টস, সেশন ভিডিও এবং লেনদেনের ফলে সৃষ্ট অন্যান্য তথ্য এবং আমাদের পরিষেবাগুলি লেনদেন সম্পন্ন হওয়ার পরে এই ধরনের তথ্য দেখার জন্য প্রয়োজনীয় কর্তৃপক্ষ এবং অনুমতি সহ যে কোন পক্ষের সাথে শেয়ার করা হবে। এর মধ্যে প্রাপক বা প্রয়োজনীয় কর্তৃপক্ষ এবং অনুমতি সহ লেনদেনের অন্যান্য পক্ষ অন্তর্ভুক্ত থাকতে পারে।

 

১৪. ক্ষতির প্রশ্ন: আমরা আপনার ব্যক্তিগতভাবে সনাক্তযোগ্য তথ্য অ্যাডভোকেট/আইনজীবী, ব্যক্তিগত তদন্তকারী সংস্থা বা আইন প্রয়োগকারী সংস্থার কাছে প্রকাশ করতে পারি যদি আমরা বিশ্বাস করি যে, (ক) আপনি অন্যের থেকে ক্ষতির ঝুঁকিতে আছেন, অথবা (খ) যে আপনি ক্ষতি করছেন বা অন্যদের সাথে হস্তক্ষেপ (বা ক্ষতি করবে বা হস্তক্ষেপ করবে) অথবা আমাদের ব্যবহারের শর্তাবলী লঙ্ঘন করছে (অথবা ইচ্ছাকৃতভাবে বা অনিচ্ছাকৃতভাবে) অথবা অন্যথায় আইনি অধিকার লঙ্ঘন করছে।

 

১৫. আইন: নোটারিবিডি পরিষেবা বা নোটারিবিডি পরিষেবার তালিকাভুক্ত নোটারি পাবলিক আপনার ব্যক্তিগতভাবে সনাক্তযোগ্য তথ্য প্রকাশ করবে যতটুকু আমরা যুক্তিসঙ্গতভাবে বিশ্বাস করি যে আইন দ্বারা আমাদের এটি করা প্রয়োজন। যদি আমরা আপনার ব্যক্তিগতভাবে শনাক্তযোগ্য তথ্য প্রকাশের জন্য আইনী প্রক্রিয়া গ্রহণ করি তবে আমরা অনুরোধের জবাব দেওয়ার আগে যুক্তিসঙ্গত সময়ের মধ্যে নিবন্ধনের সময় আপনার দেওয়া ইমেল ঠিকানার মাধ্যমে আপনাকে অবহিত করার চেষ্টা করতে পারি, যদি না এই ধরনের বিজ্ঞপ্তি অনুমোদিত না হয়।
