Power of Attorneys are distinguished as follows:
- Authenticated Power of Attorney which shall be executed before and authenticated by “Notary Public”
- Registered Power of Attorney which shall be executed and registered in the “Office of Register or Sub-Register” of Bangladesh.
We only provide “Authentication Service” under Rule 2(2) of Power of Attorneys Rule, 2015 as “Competent Officer” read with Section 33(1)(c) of Registration Act 1908 which says that “If the principal at any time aforesaid does not reside in Bangladesh a power of attorney executed before and authenticated by Notary Public shall alone be recognized.” Section 85 of Evidence Act 1872 which says that “The Court shall presume that every document purporting to be a power of attorney, and to have been executed before, and authenticated by a Notary Public was so executed and authenticated.”

Since the classified General / Special Power of Attorney deed is originated in due form of law of Bangladesh and such power of attorney is related to the subject matter of Bangladesh. Therefore, such power of attorney authenticated / notarized by an approved and certified Notary Public of Notarybd.com through Online Electronic Notary service and process according to Notaries and ICT acts of Bangladesh shall be treated as valid and legally authenticated / notarized power of attorney.
